AOI Electrical and Pro-Gard Products Sue Sensible Solutions for Infringing Airbag Switch Patent

 Indianapolis, Indiana – Patent lawyers for AOI Electrical, LLC and Pro-Gard Products, LLC, both of Indianapolis, IN, have initiated litigation alleging Sensible Solutions LLC, and its principal Robert N. Brown, both of Frederick, MD, have infringed U.S. Patent No. 6,552,657, titled DUAL-IGNITER AIRBAG CONTROL SWITCH, as issued by the U.S. Patent Office.

The plaintiffs’ asserted ‘657 patent concerns airbag-igniter switch units and methods for controlling airbag deployment in a motor vehicle. The complaint alleges that Mr. Brown filed three patent applications and submitted invention disclosure statements citing the plaintiffs’ patent as relevant prior art; these applications were rejected by Office Actions as obvious in light of the ‘657 patent and eventually abandoned. The plaintiffs claim the defendants are now making, using, selling, offering for sale, and/or importing airbag switches which infringe the ‘657 patent and cite the defendants’ brochures, installation instructions, sales invoices, and third-party Web pages as evidence of the infringement.

This case has been assigned to Judge Sarah Evans Barker and Magistrate Judge Tim A. Baker in the Southern District of Indiana, and assigned case no. 1:10-cv-00481-SEB-TAB.

Practice Tip: If a court finds that a patent was knowingly infringed, any damages awarded may be tripled.
